Could a car really make texting while driving safe? Elon Musk seems to think so-or at least, he’s willing to say Tesla’s latest Full Self‑Driving software can allow it “depending on context of surrounding traffic.” The statement, tied to the rollout of FSD v14.2.1, has electrified Tesla’s fan base and alarmed safety advocates. The reality is far less futuristic: FSD remains a Level 2 driver‑assist system, and the driver is fully liable for anything that happens.

Under SAE definitions, Level 2 means the car can handle steering and speed control simultaneously, but the human driver must maintain constant attention and be ready to take over instantly. Tesla’s own manuals make this clear. By contrast, true autonomous systems at Level 4 or 5-such as Waymo’s robotaxis-shift liability to the operator or manufacturer under certain conditions. Waymo assumes responsibility for its vehicles when operating without a human driver; Tesla does not, because its cars are not designed to operate unsupervised.
Musk’s comment suggests that Tesla will relax its driver-monitoring “nags” in low-risk operating environments, such as stop-and-go traffic. Today, in-cabin cameras track eye movement and warn drivers if their attention strays-offering repeated violations will shut down the system. The prompts have long been a sore point among owners. Yet tests by Consumer Reports and MIT’s Advanced Vehicle Technology Consortium have uncovered several methods of bypassing Tesla’s monitoring-blocking the camera or keeping hands on the wheel while looking away often doesn’t spur any warnings. In a test, Consumer Reports even found that with the cabin camera covered, both Autopilot and FSD stayed active, defeating the intent of the system to ensure driver attentiveness.
That gap matters. Computer vision systems like Tesla’s camera‑only stack can struggle with low‑light, glare, fog, or complex traffic scenarios; and without LiDAR or radar redundancy, missed detections could lead to dangerous misjudgments. It’s the multi‑sensor approach of Waymo, a robust 29 cameras and 5 LiDARs and 6 radar units, that adds layers of perception, building in cross‑verification when one sensor type falters. The Tesla vision‑only design should reduce both hardware cost and complexity, but without leaving any backup if the cameras misinterpret a scene.
The legal framework compounds the risk. Texting while driving is banned in 49 states, Washington D.C., and U.S. territories. No software update supplants those laws. In a recent Florida case, a Tesla operating on Autopilot ran a stop at an intersection and killed a pedestrian while injuring another. The driver had been reaching for his phone. A federal jury found Tesla partially responsible, awarding $242.6 million in damages but still placing two‑thirds of the blame on the driver. The verdict served to underline the fact that, in Level 2 operation, human drivers are primarily responsible even when automation has been engaged.
From an engineering standpoint, this relaxing of driver-monitoring rules in FSD v14.2.1 is no step toward higher autonomy; it’s a convenience tweak. Higher levels of autonomy require robust perception and predictive control algorithms, as well as regulatory approval. Tesla’s FSD relies on HydraNet and Occupancy Network architectures for processing camera feeds, while neural-network planners replace earlier rule-based control. These advances improve lane keeping, traffic-light handling, and turn execution, but not to the extent of removing the need for human oversight altogether. Waymo systems integrate LiDAR point-cloud processing with temporal fusion and trajectory planning in geo-fenced zones for safe driverless operation where permitted.
Regulators in most jurisdictions have yet to authorize unsupervised consumer operation of Level 3 or higher systems. Even Mercedes‑Benz’s Drive Pilot-a certified Level 3 system-is limited to specific highways and conditions, with clear boundaries regarding when the driver can disengage from active monitoring. For Tesla to legally allow texting without driver liability, the company would need to meet such standards and accept responsibility for the driving task-something Musk’s statement did not address. To those tech-savvy EV followers who track claims of autonomy, the distinction is critical. Level 2 systems like Tesla’s FSD can feel highly capable but are not autonomous in any legal or engineering sense. Relaxing monitoring in specific traffic contexts may make the experience more seamless, but doing so shifts more risk onto the driver while adding none of the value in true autonomy. The hardware, algorithms, and regulatory compliance for safe, liability-free texting while driving remain firmly out of reach.
